$30,000/Container! Wan Hai Lines Warns That There Will Be Heavy Penalties for Not Reporting Truthfully!

A few days ago, Wan Hai Lines issued an announcement stating that customers should strictly abide by any rules of Wan Hai Lines (WHL) and the requirements of applicable laws, regulations or conventions, including but not limited to declarations on the bill of lading, packaging, labels, weight, transportation or The handling, disposal of the goods, and the goods shall be truthfully and accurately declared in accordance with the above requirements and the requirements of the carrier or forwarding agent before delivery to the WHL designated location, warehouse or terminal.


Penalties for Not Reporting Truthfully_1

 

With immediate effect, Wan Hai Lines (WHL) reserves the right to stop or suspend the delivery of the goods or terminate the contract for the delivery of the goods at any time during the carriage if the attached customs declaration and transport note are untrue and inaccurate. The customer (including the shipper, the notifying party and the consignee) shall be responsible for this cost and related costs resulting from the loss, including but not limited to fines, forfeitures, attorney fees, litigation fees, etc. In addition, the following penalties shall also be paid Compensation:

 

If the goods in violation of the relevant requirements are dangerous goods, the punitive damages are USD 30,000 per container.

 

If the goods in violation of the relevant requirements are non-dangerous goods, the punitive damages shall be USD 20,000 per container.


Penalties for Not Reporting Truthfully_2

 

Previously, ZIM also issued a notice on March 8 that it would strengthen the management of concealment/omission/misreporting of the product name. Once it is found that the product name information is concealed/missed and intentionally misreported, a liquidated damages of USD 15,000/container and all additional related costs will be imposed.

 

ZIM's Notice on Strengthening the Management of Concealment/Omission/Misreporting of Goods Name:

In order to further standardize the booking of cargo names and the preparation of bills of lading, the following reminders are again made:

1. The packaging, product name, number of pieces, weight and volume of dangerous goods must be declared truthfully

2. The package, product name, number of pieces, weight and volume of the dangerous goods shown on the bill of lading must be consistent with the declaration when booking the dangerous goods

3. If there is any change after the declaration of the dangerous goods booking, you must contact the customer service of ZIM Booking Department for re-review and approval before cutting the order

4. Non-hazardous goods with special declaration requirements, including but not limited to non-hazardous chemicals and batteries, etc., should be declared consistent with the booking and bill of lading

Once ZIM finds that the product name information is concealed/missed and intentionally misreported, it will impose a liquidated damages of USD 15,000/container and all additional related costs.

ZIM hereby appeals to our customers to truthfully declare the name of the goods when booking, to ensure that the customs pre-allocated manifest, customs declaration and bill of lading information are consistent, and do not conceal, omit, or misreport, so as to avoid this penalty.
