USD 100,000 Penalty! Wanhai Shipping Issues Severe Statement!

Recently, Wanhai Shipping released a solemn reaffirmation notice regarding incidents of cargo misdeclaration, under-declaration, and false declaration.
Wanhai Shipping stated that it will pursue full and unlimited recovery from the responsible party in accordance with relevant international conventions and terms of the transportation contract. It also emphasized that if the act constitutes a crime, it will be unhesitatingly transferred to judicial authorities for criminal liability, with no leniency or tolerance.
Specific Terms of the Statement
To ensure the safety of ships, cargo, and other third parties, provide a safe maritime transportation environment, and protect the interests of customers, Wanhai Shipping once again stresses that all customers must declare cargo truthfully and correctly. For any misdeclaration, under-declaration, false declaration, or other inaccurate declaration of cargo, the carrier has the right to charge the shipper a penalty in accordance with the terms agreed upon when signing the transportation contract:
Dangerous Goods Containers: Real CLASS, UN number, detailed product name, dangerous goods declaration form, and packaging certificate must be provided. If misdeclaration, under-declaration, or inconsistency between declared and actual cargo is found, the shipper (Party A) must pay a penalty of USD 100,000 per unit and settle the payment within 7 days of notification from Wanhai Shipping (Party B).
Non-Dangerous Goods: If the misdeclared, under-declared, or falsely declared cargo is non-dangerous, Party A shall pay a penalty of USD 100,000 per unit and bear all risks, liabilities, and compensation for losses arising therefrom. Payment must be made within 7 days of Party B’s notification.
Deposit Requirement: For any misdeclared, under-declared, or falsely declared cargo, upon Party B’s notification, Party A must immediately pay USD 100,000 per unit as a deposit. This deposit will cover subsequent costs such as container damage, extended detention fees (detention fees related to misdeclaration will be tripled), terminal fees, and customs handling fees in various regions. It will also cover all risks, liabilities, and compensation for losses caused by safety accidents. If the deposit is insufficient, Party A must make up the difference, with payment due within 7 days of Party B’s notification.
Notably, in addition to the above penalties and deposits, Wanhai Shipping will also reserve the right to claim compensation from the responsible party and pursue its legal liability.
